IN THE COURTS:
A&S Retained to Resist Challenge to Coral Casino Rehabilitation. The Member Committee of the Coral Casino Beach and Cabana Club retained Doug Large to join in the defense of a lawsuit brought to stop the planned historic renovation of the Coral Casino. The Santa Barbara Superior Court, the Honorable Thomas P. Anderle, judge presiding, rejected the challenge to the Clubs rehabilitation and entered judgment for all defendants. A&S Helps Secure Favorable Settlement in Alleged False Advertising Class Action.
An A&S team led by Doug Large and working with co-counsel OMelveny & Myers LLP brought a proposed nationwide class action against a product manufacturer to an early and favorable settlement. The case arose out of allegations that, during the 1990s, the manufacturer had engaged in misleading advertising to promote sales of one of its products.
Defense Verdict in Schools "Negligent Supervision" Case
Korman Dorsey Ellis and Marcus J. Kocmur successfully defended the Simi Valley Unified School District in a personal injury / negligent supervision case. In a 3-day court trial before the Honorable Steven Hintz in Ventura County Superior Court, a junior high school student sought in excess of $100,000 for a fractured tibia, after she fell from a piece of gym equipment during a PE class. The student claimed that inadequate instruction and supervision, and inadequate maintenance of the gym equipment, had all caused or contributed to her accident. The court found that the student failed to prove that the District was negligent and entered judgment for the defense.
A&S Assists in EXXONMOBIL Victory
Exxon Mobil Corporation defeated a breach of contract action by Southern California Gas Company arising out of Exxons gas production in the Santa Barbara Channel, with the assistance of Doug Large, Ken Moes, Michael Colton and Marcus Kocmur. Archbald & Spray LLP served as co-counsel with the Texas firm of Baker Botts LLP.
Plaintiffs Verdict in Contract, Fraud Case
Ed Loskamp obtained a court judgment of $430,000 ($100,000 punitive damages) in Santa Barbara Superior Court on behalf of a small-business client in a breach of contract and fraud case against an independent contractor who absconded with goods she was hired to promote.
Favorable Settlement Secured in El Escorial Case
A & S Senior Partner Ken Moes negotiated a favorable settlement in a construction defect lawsuit arising out of the condominium conversion of Santa Barbaras El Escorial Hotel and Kingswood Village apartments. Plaintiffs sought damages of $50 million; the corporate developer and contractor settled for $5.5 million. Mr. Moes represented an individual client with interests in the corporate entities. The case went to trial against various subcontractors.
